1. About Shinda Gari

Shinda Gari ("the Company", "we", "us") operates a lawfully conducted monthly prize draw competition in Kenya, regulated under the Kenya Gaming Act (Cap. 131) and subsidiary legislation. Competition Licence Reference: KGA/DRW/2026/SG-0441 (placeholder pending final issuance).

2. Eligibility

• Must be 18 years of age or older.
• Open to residents of Kenya and internationally, except where local law prohibits participation.
• Employees, directors, agents and their immediate family members of Shinda Gari are excluded.
• We reserve the right to verify eligibility and disqualify any non-eligible participant without refund.

3. How to Enter

• Purchase 1–10 tickets per monthly draw via the website using accepted cryptocurrency.
• Maximum 10 tickets per person per draw.
• Tickets are single-use, non-transferable and valid only for the draw in which they are purchased.
• Entry is complete only upon confirmed payment receipt. Unconfirmed or failed payments do not constitute valid entries.
• You must provide a valid email address. We bear no responsibility for missed notifications due to incorrect details.

4. Ticket Prices & Payment

• 1 ticket: $10 USD · 3 tickets: $25 USD · 5 tickets: $40 USD
• KES equivalents shown on site are indicative only. USD amounts are binding.
• Payment accepted in USDT (TRC20/ERC20/BEP20), Bitcoin, Ethereum, and BNB only.
• All payments are final and non-refundable. Cryptocurrency transactions are irreversible.
• We are not liable for payments sent to incorrect addresses, wrong networks, or with insufficient fees.
• You bear full responsibility for ensuring correct payment details before sending.

5. The Draw

• Draw takes place on the last Saturday of each calendar month at 21:00 EAT (UTC+3).
• Winner selected by certified random number generation, witnessed by an independent party.
• Results published on the website and emailed to all participants within 24 hours of the draw.
• Draw date may be postponed due to force majeure, technical failure, or regulatory requirement. Participants will be notified.
• We reserve the right to cancel or postpone a draw and issue full ticket refunds in exceptional circumstances at our sole discretion.

6. The Prize

• Prize is the vehicle advertised on the website for that specific draw period.
• Prize excludes insurance, registration, taxes, shipping, customs duties, and all other costs of ownership unless explicitly stated.
• Winner is solely responsible for all costs of collection, registration and insurance of the vehicle.
• No cash alternative. The prize cannot be exchanged, resold, or transferred.
• Prize must be claimed within 30 days of notification. Forfeited if unclaimed.
• Vehicle condition, mileage and specifications are as stated in the listing. Images are representative.
• We reserve the right to substitute the prize with one of equal or greater value if the advertised vehicle becomes unavailable.

7. Winner Notification & Verification

• Winner notified by email and telephone using details provided at purchase.
• Winner must provide valid government-issued photo ID and proof of address within 14 days.
• We reserve the right to disqualify and select an alternate winner if identity cannot be verified.
• Winner agrees to participate in reasonable publicity (name announcement, photo) unless they opt out in writing.

8. No Guarantee of Winning

This is a game of pure chance. Purchasing a ticket does not guarantee a win. Your probability of winning is proportional to the number of valid tickets you hold versus total tickets sold. We make no representation or warranty that any individual will win.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Shinda Gari, its directors, officers, employees, agents, partners and affiliates shall not be liable for:

• Any indirect, incidental, consequential, special or punitive damages of any kind.
• Technical failures, internet outages, cryptocurrency network congestion or any event outside our reasonable control.
• Losses arising from participant error including incorrect addresses, wrong networks, or incorrect personal information.
• Any financial, legal, personal or professional consequences arising from participation.
• Fluctuations in cryptocurrency value between the time of payment and any future date.

Our total aggregate liability to any participant shall not exceed the ticket purchase price paid for that specific draw.

10. Responsible Gaming

• For entertainment purposes only. Never spend more than you can afford to lose.
• If you believe you have a gambling problem, please contact a licensed support service.
• We reserve the right to refuse or revoke participation from any individual at our sole discretion.
• We do not target or market to vulnerable persons or minors.

11. Cryptocurrency Disclaimer

• We are not a financial institution or regulated payment processor.
• Cryptocurrency values fluctuate. We are not liable for any loss arising from exchange rate movements.
• Blockchain transactions are irreversible. Once sent, payments cannot be recalled or reversed.
• We are not responsible for delays or losses caused by network congestion, miner fees, or blockchain forks.

12. Fraud & Abuse

Any attempt to manipulate the draw, create multiple accounts, or engage in fraudulent activity will result in immediate disqualification without refund and may be reported to relevant authorities.

13. Intellectual Property

All website content including text, images, logos and design is owned by Shinda Gari. Reproduction without written consent is prohibited.

14. Privacy

Your personal data is processed per our Privacy Policy and Kenya Data Protection Act 2019.

15. Amendments

We may amend these Terms at any time. Material changes will be communicated on the website. Continued participation constitutes acceptance of amended terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of Kenya. Any disputes shall be resolved exclusively by the courts of Kenya.
